JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-06-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor representing the State. By order, dated 18.10.2016, the petitioner was allowed provisional bail.
The allegation against the petitioner is of misappropriation of a sum of Rs. 27,53,955/-. The said interim protection was given to the petitioner to enable him to apply for adjustment of the amount before the appropriate authority.
It is submitted on behalf of the petitioner, with regard to the pleadings on record, that the petitioner has tried to furnish all the documents before the Investigating Officer of the case, but he refused to receive the same.
Patna High Court Cr.Misc. No.42546 of 2016 (4) dt.21-06-2017 2/2 According to him, he has applied for adjustment of the amount, alleged to be misappropriated by him, before the appropriate authority in compliance of the orders of this Court, dated 18.10.2016.
Since the petitioner was granted provisional bail and the allegation against him relates to failure to get the amount adjusted, which he had taken as advance for work under MANREGA, a case for grant of anticipatory bail is made out.
Considering the facts and circumstances, this application is allowed and the provisional bail, granted to the petitioner by order, dated 18.10.2016, is hereby confirmed.
This is subject to the condition that the petitioner shall present himself before the Court, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
