Mr. Sri Abhay Kumar - 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-07-2018 Heard the learned counsel for the petitioner and the State.

The petitioner seeks bail in anticipation of his arrest in connection with Parsauni P.S. Case No. 106 of 2016 dated 24.12.2016 instituted for the offences under Sections 363, 366A/34 of the Indian Penal Code. The informant has alleged that his minor daughter did not come back home after she had gone out of her house for attending classes in a coaching centre. Later during course of search, two of the covillagers of the informant apprised him that the petitioner and others had abducted his daughter on a sumo vehicle.

During course of investigation, the victim surfaced and made statement under Section 164 Cr.P.C.

No.33685 of 2018(3) dt.04-07-2018 2/2 In the aforesaid statement she has disclosed her age to be 19 years and has categorically stated that she has married the petitioner of her own choice and the story of kidnapping/abduction is incorrect. She has also stated that she is leading a happy matrimonial life with the petitioner.

Regard being had to the aforestated facts, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Parsauni P.S. Case No. 106 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
