The petitioner, in the present case, is seeking regular bail in connection with S.T. No. 91 of 2020 arising out of Kalyanpur P.S. Case No. 303 of 2019 registered for the offence under Sections 302, 120(B) and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case due to village politics. Learned counsel submits that there is no specific allegation of firing against this petitioner rather the specific allegation of firing upon the deceased is against coaccused Bablu Mahto. Patna High Court CR. MISC. No.29237 of 2020(12) dt.22-02-2021 2/2 custody since 09.11.2019.
Learned A.P.P. for the State is present and has opposed the prayer for regular bail of the petitioner. Having regard to the facts and circumstances of the case, wherein the learned counsel for the informant has brought to the notice of this Court that the trial is at the fag end and is likely to be concluded in next three months, this Court is not inclined to grant privilege of regular bail to the petitioner, particularly after noticing that he has got five criminal antecedents.
Let the trial be concluded at the earliest. The trial court shall conduct the trial on day to day basis and conclude the trial preferably within a period of three months from today.
