Learned counsel for the petitioners outrightly submits that petitioner is ready to pay the compounding fee as mentioned in Rule 56 of the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation & Storage) Rule and as per Rule 56, the petitioner is required to deposit Rs. 2,00000/- (Rupees two lakhs), one lakh each for each truck in question, and if the petitioner has deposited the aforesaid amount within a period of two weeks before the District Mining
Patna High Court CWJC No.7307 of 2023(4) dt.19-06-2024 2/2 Officer, Sitamarhi, the District Mining Officer, Sitamarhi is directed to release the trucks in question in favour of the petitioner after due verification.

Learned counsel for the petitioners further submits that as per instruction till date the confiscation proceeding has not been initiated against the petitioners.

In view of the aforesaid, the writ petition stands disposed of with the aforesaid direction.
