JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 28-06-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Complaint Case No. 840 of 2012 for the offences punishable under sections 403, 406, 420 and 120 (B) of the I.P.C.
On behalf of the petitioner it is submitted that the dispute between the parties has been compromised and the compromise petition has been filed in the learned court below. The certified copy of the compromise petition has been filed by the petitioner today which is kept on the record. It is submitted that in
Patna High Court Cr.Misc. No.1065 of 2017 (5) dt.28-06-2017 2/2 view of compromise arrived at between the parties the opposite party no.2 is not coming in this case personally and as such the petitioner deserves sympathetic consideration. The learned A.P.P. submits that in view of compromise arrived at between the parties lenient view can be taken.
In the facts and circumstances as stated above, considering the compromise arrived at between the parties, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Rohtas at Sasaram in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
