The petitioner apprehends her arrest in Mahesh Khunt P.S. case No. 171 of 2017 for the offences punishable under Sections 420, 409 and 468 of the Indian Penal Code. The petitioner is a ward member and there is allegation that the petitioner and other accused person presented bill for payment for construction of lavatories but only one lavatory was constructed and many persons by affixing their photographs presented bills for payment for construction of many lavatories.

It is submitted that similarly situated Rojgar Sewak and other ward members have already been granted anticipatory bail vide orders passed in Cr. Misc. No. 10818/2018, Cr. Misc.

Patna High Court Cr.Misc. No.34002 of 2018 (2) dt.28-06-2018 2/2 No. 12258/2018 and Cr. Misc No. 17697/2018.

Taking into consideration the fact that similarly situated accused person have already been granted anticipatory bail, the petitioner above named in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateIII, Khagaria, in connection with Mahesh Khunt P.S. case No. 171 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
