JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Shikarpur P.S. Case No. 418 of 2019 for the offence under Sections 461 and 379 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner would submit that the petitioner was not named in the first information report.
The allegation against the petitioner is that he was involved in steal away A.T.M Machine with cash of Rs. 2,60,500/-.
Learned counsel appearing on behalf of the petitioner submits that the name of the petitioner surfaced during course of investigation and except money, there is no material to connect

Considering the fact that the petitioner was not named in the FIR and he is in custody since 10.12.2019, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran in connection with Shikarpur P.S.
