The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 324, 325, 307, 379 of the Indian Penal Code.

The prosecution case as per F.I.R is that all the accused persons including petitioners, variously armed came to the house of the informant and assaulted the

Patna High Court CR. MISC. No.29295 of 2022(2) dt.18-10-2022 2/3 brother of the informant. When other family members of the informant came to his rescue, they were also assaulted by the co-accused persons.

It is submitted by learned counsel for the petitioners that in the background of some land dispute, the present occurrence took place. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. It is further submitted that from perusal of the impugned order it appears that the injury sustained by the injured persons are simple in nature. However, the mother of the informant namely, Phula Devi had sustained head injuries. There is no specific allegation of assaulting to the mother of the informant, against any petitioner.

In the facts and circumstance of the case, let the petitioner, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands)

No.29295 of 2022(2) dt.18-10-2022 3/3 each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, V, Sikrahana, Dhaka in connection with Chiraiya (Shikarganj) P.S. Case No. 367 of 2021 (G.R. No. 1504 of 2021), subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
