Petitioner apprehends his arrest in connection with Barari P.S. Case No. 18 of 2018, registered for the offences punishable under Section 307 of the Indian Penal Code and Section 27 of Arms Act.

The informant, Harilal Yadav alleged that co-accused Manoj Yadav came at the house of the informant and shot fire from his pistol upon his son namely Mukesh Kumar Yadav and his nephew Rana Kumar Yadav but any how Mukesh Yadav escaped but the bullet hit to his nephew Rana Yadav and he sustained bullet injury and thereafter he was brought to Referral Hospital, Barari. It has further alleged that co-accused Prabhash Yadav was

Patna High Court Cr.Misc. No.33795 of 2018 (2) dt.07-06-2018 2/2 also involved in the alleged occurrence.

The learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case only on suspicion. It has been further submitted that the petitioner is not named in the FIR, during course of investigation on the basis of statement of co-accused Rana Yadav, the name of the petitioner has been surfaced.

Considering the facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Katihar in connection with Barari P.S. Case No. 18 of 2018, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
