In this application for anticipatory bail the petitioner apprehends his arrest in connection with Pipra P.S. Case No. 202 of 2017 for the offence punishable under section 392 of the I.P.C. Allegedly, amount of Rs. 60,000/- was taken out from the informant by the petitioner on the point of Nalkatti and the petitioner described himself as a member of M.C.C. Submission is of false implication and that there is no legal and cogent material against the petitioner, due to malafide intention he has been implicated, he was not seen at the spot, nothing has been recovered from his possession and as such he

Patna High Court Cr.Misc. No.55056 of 2017 (4) dt.15-01-2018 2/2 deserves sympathetic consideration.

The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner by submitting that the petitioner is named in the FIR and he has been identified by the informant and further he has got criminal antecedent.

In the facts and circumstances stated above, I am not inclined to grant privilege of pre-arrest bail to the petitioner and accordingly his such prayer stands rejected in connection with the aforementioned case pending in the court of C.J.M. Motihari, East Champaran.
