JUSTICE MUNGESHWAR SAHOO ORAL ORDER 23-02-2015 Learned counsel Mrs. Meera Singh, A.C. to A.A.G.13 after consultation with learned A.A.G.13 seeks permission to withdraw this first appeal on the ground that valuation of this first appeal is only Rs.3,01,396.50 and it arises out of land acquisition matter whereas the State Government by Notification No.14/D.L.A.-Niti (Pratham Appeal)-113/13-1544/Ra, dated 03.12.2014 has decided to withdraw all the first appeals the valuation of which is upto to Rs.3 lacs. Learned A.C. to A.A.G.13 submitted that the valuation of the first appeal is, Rs.1,396.50 in excess of valuation of Rs.3 lacs. Therefore, in view of the said notification, the appellant may be permitted to withdraw this first appeal.

In view of the aforesaid submission of the learned A.C.

Patna High Court FA No.435 of 1994 (23) dt.23-02-2015 to A.A.G.13 this first appeal is permitted to be withdrawn. Accordingly, the first appeal is dismissed as withdrawn. (Mungeshwar Sahoo, J) Harish/- U
