Petitioner is an accused in connection with G.B. Nagar P.S. Case No. 87 of 2020 for the offence registered under Sections 30(a), 34, 36, 38 and 41(1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the instant case. It is further submitted that though the petitioner is named in the first information report but nothing has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 07.06.2020.

Learned A.P.P. appearing on behalf of the State submits that petitioner has criminal antecedent.
