The petitioner apprehends arrest in connection with Agamkuan P.S. Case No. 603 of 2017 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that from perusal of seizure list, it appears that nothing has been recovered from the conscious possession of the petitioner. The alleged recovery has been made from the open field. Further submission is that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the

Patna High Court Cr.Misc. No.34462 of 2018(2) dt.20-06-2018 2/2 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna in connection with Agamkuan P.S. Case No. 603 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
