2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 75(1) of the B.N.S. and Section 8 of POCSO Act.

3. The case of the prosecution, in short, is that the petitioner who is a teacher has touched inappropriately the minor son of the informant.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this

Learned counsel for the petitioner has submitted that during course of investigation, the victim has given his statement under Section 183 of the B.N.S.S. wherein he has stated that at the time of occurrence, one Abhishek was also there and has stated that the petitioner has inappropriately touched his body. Learned counsel for the petitioner has further submitted that during course of investigation, Abhishek has also given his statement and has stated that no such occurrence has taken place before him. It has further been submitted that actually the fee was due and that is why, the victim was told for depositing the fee and in counterblast, this case has been filed. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 12.03.2026.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, POCSO Act-cum-District &
