JUSTICE SUDHIR SINGH ORAL ORDER 04-08-2021 Learned counsel for the petitioner is directed to remove the defects, as pointed out by the office, within a period of four weeks from the date of restoration of normalcy. Heard learned counsel for the petitioner and learned A.P.P. for the State through Virtual mode.

The present application has been filed for modification of the order dated 20.05.2021, passed in Cr. Misc. No. 2964 of 2021, by which the petitioner was granted anticipatory bail in connection with Special Case No. 5497/2020, arising out of Digha P.S. Case No. 509/2020, pending in the court of learned Special Judge, Excise, Patna, and the petitioner was directed to surrender in the court below within a period of twelve weeks.

No. 2964 of 2021, at the top of first page, Thana-'Rajivnagar' has wrongly been mentioned in place of Thana-'Digha'. Likewise, in paragraph no. 7, 'learned court below' only has been mentioned in place of 'learned Special Judge, Excise, Patna, in connection with Digha P.S. Case No. 509 of 2020'.

Considering the submissions made on behalf of learned counsel for the petitioner and the grounds mentioned in the modification application, let in the order dated 20.05.2021, passed in Cr. Misc. No. 2964 of 2021, at the top of first page, Thana-'Digha' be read in place of Thana- 'Rajivnagar', and in paragraph no. 7, 'learned Special Judge, Excise, Patna, in connection with Digha P.S. Case No. 509 of 2020' be read in place of 'learned court below' and the period of surrender of the petitioner in the court below is extended for a further period of eight weeks from the date of receipt/production of a copy of this order. The rest of the conditions stipulated in the order will be same.

The order dated 20.05.2021 passed in Cr. Misc. No. 2964 of 2021, is modified to the extent as indicated above. The present application is disposed of.
