The petitioner seeks bail in connection with N.D.P.S. Case No. 07 of 2021 arising out of Ramgarh (Nuaon) P.S. Case No. 61 of 2021 instituted for the offences under Sections 8, 20 (b) (ii) A of the N.D.P.S. Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 07.03.2021 and charge-sheet has been submitted in the case.

Learned counsel for the petitioner submits that allegation is of recovery of 500 grams of ganja from the possession of the petitioner.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.39016 of 2021(4) dt.24-01-2022 2/2 petitioner has been falsely implicated in the present case, nothing was recovered from his possession and even presuming what has been alleged in the F.I.R. is true, still the recovery is less than the small quantity.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner and submits that the petitioner has got three criminal antecedents out of which one is under the N.D.P.S. Act.

Considering the fact that the petitioner is in custody since 07.03.2021, charge-sheet has been submitted in the case and recovery of ganja is less than the small quantity, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (N.D.P.S.), Kaimur at Bhabhua in connection with N.D.P.S. Case No. 07 of 2021 arising out of Ramgarh (Nuaon) P.S. Case No. 61 of 2021 with a condition that one of the bailors shall be the son of the petitioner. (Satyavrat Verma, J) Rishi/- U T
