This application is for grant of regular bail in connection with Masaurhi P.S.Case No.283 of 2018 (in S.Tr. No.702 of 2018) for the offences under Sections 302/34 of the Indian Penal Code.

Prosecution case is that the petitioner and his wife dragged the husband of the informant inside the house and later on his dead body was found on the ground and blood was coming out from the head.

Submission of the learned counsel for the petitioner is that there is no eye witness of the occurrence and co-accused Chanda Devi has been granted bail. Petitioner is in custody since 30.7.2019.

Heard learned A.P.P. who has opposed the prayer

Patna High Court CR. MISC. No.29671 of 2019(6) dt.25-02-2020 2/2 for bail on the ground that during investigation several witnesses have supported the prosecution case.. Having heard both sides and considering the above, I am not inclined to grant bail to the petitioner, however, once the informant and other eye witnesses have been examined, petitioner is at liberty to renew his prayer for bail. With the aforesaid observation, this application is dismissed.
