2. The petitioner seeks bail in connection with G.R. No. 7022 of 2024, arising out of Bihar Sharif (Bihar) P.S. Case No. 824 of 2024, instituted for the offences punishable under Section 309(4), 310(2), 317(2) of the Bharatiya Nyaya Sanhita, 2023.
3. The prosecution case, in short, is that, some unknown miscreants entered into the house of the informant at night and on the point of pistol looted cash, jewellery and other articles from his house.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged
Patna High Court CR. MISC. No.33597 of 2025(3) dt.11-07-2025 2/3 against him and has falsely been implicated in the present case due to dirty village politics. The petitioner has not committed any offence as alleged in the F.I.R. He further submits that nothing incriminating/looted article has been recovered from the conscious/physical possession of the petitioner. The petitioner is not named in the F.I.R. and his name has surfaced in this case on the basis of the confessional statement of the co-accused. No T.I. Parade has been conducted in this case. The petitioner has one criminal antecedent in which he is on bail and is languishing in judicial custody since 22.11.2024 without any rhymes or reason.
5. Learned counsel for the petitioner again submits that the co-accused namely Mukhiya @ Rajpal Kumar has been granted bail by this Court vide order dated 07.04.2025 passed in Cr. Misc. No. 18943 of 2025.
6. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged against the petitioner is serious in nature.
7. Having heard rival contention of both the parties and considering the entire facts and circumstances of the case, the period of custody of the petitioner and the prayer for bail
Patna High Court CR. MISC. No.33597 of 2025(3) dt.11-07-2025 3/3 being based on parity, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with G.R. No. 7022 of 2024, arising out of Bihar Sharif (Bihar) P.S. Case No. 824 of 2024.
