29-06-2018 Heard Sri Ajay Kumar Tiwary, learned counsel for the petitioners and learned Addl. Public Prosecutor. Two petitioners, having clean antecedent, which fact has been stated in paragraph - 3 of the petition, apprehending their arrest in Raghunathpur P.S. Case No. 191 of 2017 registered for offence under Sections 272, 273, 308 of the Indian Penal Code and Sections 30, 38, 41 of Bihar Prohibition and Excise Act, 2016, have prayed for grant of bail in the event of their arrest or surrender, purely on the ground of parity. It has been argued that out of 9 accused, at least 5 accused persons, in similar circumstances, have been extended the privilege of anticipatory bail, vide Cr. Misc. No. 9564 of 2018, Cr. Misc. No. 12251 of 2018 and Cr. Misc. No. 17631 of
Patna High Court Cr.Misc. No.36707 of 2018(2) dt.29-06-2018 2/2 2018 respectively. It has been reiterated that petitioners' case is also similar to the cases of other accused persons, who have been granted anticipatory bail.
Besides hearing, I have also perused the material on record and considering the fact that most of the accused, in similar circumstances, have been extended the privilege of anticipatory bail, there is no reason to pass different order. Accordingly, in the event of their arrest or surrender within a period of six weeks from today, let both petitioners namely Jitendra Chaurasia and Raja Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Siwan in connection with Raghunathpur P.S. Case No. 191 of 2017, subject to condition as contemplated under Section 438(2) of the Cr.P.C.
