Heard the parties.

The petitioners are languishing in custody for the offence punishable under Sections 302/201/34 of the Indian Penal Code.

F.I.R. was lodged on recovery of the dead body of the brother of the informant. Since brother of the informant was in talking term with the beloved girl who is co-accused of this case and the girl was married in the family of the petitioners, suspicion is that the petitioners and others have committed

Patna High Court CR. MISC. No.25347 of 2020(2) dt.28-09-2020 2/2 murder.

Learned counsel for the petitioners submits that besides suspicion, there is no other material. Petitioners are in custody since 05.01.2020. Investigation of the case is already complete.

Considering the facts aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Patna Junction (Rail) P.S. Case No. 01 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.

(c) The petitioners shall not leave the country without permission of the trial Court.
