This is an application for grant of anticipatory bail in connection with Islampur PS case no. 207 of 2017 registered for the offences punishable under Section 414 of Indian Penal Code. The allegation is regarding the police receiving secret information that one Bolero vehicle has been parked forcibly by the petitioner at the brick kiln situated towards the western side of the Sun temple whereafter, the police had raided the said brick kiln and found the said Bolero vehicle parked there. Upon enquiry, it transpires that the said vehicle was a stolen one and was being used by the petitioner for nefarious activities.
The learned counsel for the petitioner submits that neither

No.62243 of 2017 (2) dt.04-01-2018 2/2 the petitioner is the owner of the vehicle nor the vehicle was apprehended from the possession of the petitioner nor there is any material to connect the petitioner with the said vehicle and merely on suspicion, the petitioner has been roped in the present case. It is further submitted that barring one other case in which the petitioner is on bail, the petitioner has a fair antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and appropriate to admit the petitioner to the privilege of anticipatory bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Hilsa (Nalanda) in connection with Islampur PS case no. 207 of 2017 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
