The writ application was filed impugning the two notices (Annexures 1 and 8) issued to the petitioner by the respondents under Public Land Encroachment Act. It is stated that the land appertaining to plot no. 271 khata no. 203 is the land purchased by the petitioner under a sale deed. The issuance of notice was, illegal/uncalled for.
A counter affidavit on behalf of the respondent nos. 3 to 4 is filed.
Mr. Srivastava has drawn attention of the Court to the averments made in para-9 wherefrom it appears that the
Patna High Court CWJC No.20380 of 2013 (3) dt.29-06-2016 2/2 respondents later found that the subject land is the land owned by the petitioner under sale deed.
In the light of the aforesaid statement made in the counter affidavit, Mr. Srivastava submits that the grievance of the petitioner has been redressed.
The writ application stands disposed of as having become infructuous.
