2. The petitioner is apprehending arrest in connection with Alamganj P.S. Case No. 136 of 2026 lodged on 10.02.2026, for the offence punishable under Sections 111, 61(2) of the Bharatiya Nyaya Sanhita, 2023 and 25(1-B)(a), 26 and 35 of Arms Act, 1959.
3. As per the prosecution, FIR has been lodged against six named accused persons including the present petitioner.
4. Prosecution story, in brief, is that On 09.02.2026, the informant, along with a police team, produced four suspects and a vehicle bearing registration no. BR-01-JU-6617 at the police station for verification and interrogation. The suspects initially attempted to conceal their identities by furnishing false
2/4 names and addresses; however, upon sustained interrogation, they were identified as Badal Kumar @ Badal Yadav @ Ashish Yadav, Kunal Raj, Akash Kumar, and Jitendra Kumar. During interrogation, the accused disclosed that they had conspired to murder Suraj Bhainhiya and Sunil Bhainsiya on account of ongoing land disputes and prior enmity. The conspiracy involved hiring contract killers and fixing the consideration amount for the same. The accused had assembled at Koderma Valley to plan the crime while consuming liquor, and had contacted associates - including Govind Dome and Ashish Pandey - to facilitate execution of the murder. It was further disclosed that a stolen Pulsar motorcycle bearing registration no. BR-01-ES-5608 had been arranged and kept near Mehndiganj Bridge for use in the planned offence.
Acting on this disclosure, the police team conducted a raid near Mehndiganj Bridge and recovered the stolen motorcycle. Thereafter, a search was conducted at the residence of accused Badal Kumar @ Badal Yadav @ Ashish Yadav, in compliance with legal procedure, in the presence of an independent police witness and under videography.
3/4 automatic pistol (marked "Made in USA"), Multiple live cartridges (7.65 mm and 8 mm). All recovered items were seized, and a seizure list was duly prepared.

Learned counsel for the petitioner submits that the name of the petitioner came from the confessional statement of four arrested person who where preparing to hire contract killer in order to kill two persons. It is further submitted that the petitioner is innocent and his name has been used for contract killer on mere reference.
6. Learned APP for the State has vehemently opposed the prayer for grant of bail of the petitioner.
7. Taking into consideration that the entire story narrated in the F.I.R is in respect to hiring of a contract killer for a purpose of murder where the name of the petitioner is mere co-incidental.

In the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of learned ACJM-VI, Patna City in connection with Alamganj P.S. Case
4/4 No. 136 of 2026, subject to the conditions as laid down U/s 482(2) of the B.N.S.S., 2023 and also subject to the following conditions:
(I) One of the bailors shall be the petitioner's own or close member.
(II) The petitioner shall appear on each and every date fixed during the trial and also co-operate in the process of trial. (III) The petitioner shall not tamper with the prosecution evidence or influence/intimidate any witness during the course of trial.
(IV) The Petitioner shall not commit offence of a similar nature in future.
(V) The Petitioner shall not leave the territorial jurisdiction of the learned court below without prior permission of the court concerned.
In case of violation of any of the aforesaid conditions, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
