Petitioners apprehend their arrest in a case registered for the offence punishable under Section 457, 380 of the Indian Penal Code.
As per the prosecution case, these petitioners along with other accused persons committed theft of CCTV camera and other articles in the house of informant. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case due to old dispute. No incriminating article has been recovered from the conscious possession of the petitioners and
Patna High Court CR. MISC. No.38921 of 2021(4) dt.28-07-2022 2/2 they are no way concerned with the alleged recovery. There is no seizure list of stolen CCTV camera. Petitioners have got clean antecedent.
Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that during the course of investigation stolen CCTV camera has been recovered from the house of these petitioners.
Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
