The petitioner apprehends his arrest in Excise case No. 446/2019, arising out of Ara Town P.S. case No. 134/2019, registered under Section 414 of the IPC and u/s 30(a) of Bihar Prohibition & Excise Act.

The informant saw two persons standing with a vehicle on which a fish crate was tagged. After seeing the police the accused persons started fleeing away but on chase one Jitendra Kumar was apprehended who disclosed that petitioner managed to flee away.

The learned counsel for the petitioner submits that petitioner has no manner of concern with the liquor recovered from the vehicle. The petitioner is not the owner of the vehicle. Considering the facts aforesaid and nature of

No.30246 of 2019(2) dt.08-05-2019 2/2 allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV-cumSpecial Judge, Excise Act, Bhojpur, Ara in connection with Excise case No. 446/2019, arising out of Ara Town P.S. case No. 134/2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
