Heard learned counsel for the petitioner and the State. The petitioner prays for grant of anticipatory bail in Danapur P.S. Case No. 501/2014 registered for the offence punishable under Sections 419/420/120(B)/467/468 of the Indian Penal Code.

The brother of the petitioner was impersonated as the petitioner and was appearing in the examination for recruitment of constables.

The petitioner being the beneficiary cannot escape his criminal liability.

In view of the above, this is not a fit case for grant of anticipatory bail. It is, accordingly, dismissed.

If the petitioner surrenders within four weeks, then the Court below shall not be prejudiced by the fact that anticipatory bail of the petitioner has been dismissed and while considering the regular bail of the petitioner, the Court below shall also consider the fact that the co-accused brother of the petitioner has been granted regular bail.
