JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-12-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Sanhaulla P.S. Case No. 132 of 2017 registered for the offence punishable under sections 379 of the Indian Penal Code and section 7 of the Essential Commodities Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case merely on suspicion. Petitioner was not arrested on the spot nor anything has been recovered from his possession. Shop of the petitioner has not bee searched till date. Petitioner is a man of clean antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period

No.54204 of 2017(3) dt.21-12-2017 2/2 of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, V, Bhagalpur in connection with Sanhaulla P.S. Case No. 132 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
