The petitioners apprehend their arrest in connection with Pakribarawan P.S. Case No. 241 of 2016 for the offence punishable under Sections 341, 353, 379, 419, 420, 467, 468, 147 and 149 of the Indian Penal Code and Section 40 of the Bihar Minor Mineral Concession Rule, 1973 and Section 8 of the Bihar Minerals (Prevention of illegal Mining, Transportation and Storage) Rules, 2003. Learned counsel appearing for the petitioners submits that the petitioners, who are of clean antecedent,

Patna High Court CR. MISC. No.28040 of 2019(2) dt.29-04-2019 2/2 are innocent and have not committed any offence. In fact, the petitioners happen to be driver of the alleged vehicle and they are not involved in illegal transporting of sand. Hence, the petitioners may be granted the privilege of anticipatory bail.

Considering the facts and circumstances of the case, let the, above named, petitioner in the event of surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M.-1st Class, Nawada in connection with Pakribarawan P.S. Case No. 241 of 2016 subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Arvind Srivastava, J) brajesh/- U T
