02. In the present case, the petitioner is apprehending his arrest in connection with Parbatta P.S. Case No. 504 of 2024 registered for the alleged offence under Sections 352, 351(2), 87, 3(5) of Bharatiya Nyaya Sanhita, 2023.
03. As per prosecution case, petitioner and other coaccused persons giving allurement to the wife of the informant made her to leave her house with ornaments worth Rs. 1,35,000/- and cash of Rs. 2,00,000/-.
04. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this
Patna High Court CR. MISC. No.33937 of 2025(2) dt.22-05-2025 2/3 case. Completely vague and general allegations have been levelled against the petitioner and others. The wife of the petitioner is aged about 34 years and from the FIR, it is apparent that she left her house from her own. The FIR has been lodged after 21 days without any satisfactory explanation for the delay. During hearing of the bail petition before the learned Sessions Court, the victim appeared and she stated that she left her house on her own. The statement of the victim lady was not recorded and the informant has also not disclosed that this petitioner is his maternal cousin and the present case has been lodged to pressurize the petitioner as the informant wants to take share in the maternal property. There is no material to show the involvement of the petitioner and there is no witness to any of the allegations. The petitioner is having clean antecedent.
05. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Having regard to the facts and circumstances and submission made on behalf of the parties and considering the completely vague and doubtful nature of allegation against the petitioner and also considering the clean antecedent of the petitioner and possibility of false implication, let the petitioner above named, in the event of his arrest or surrender before the

No.33937 of 2025(2) dt.22-05-2025 3/3 court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Khagaria/court concerned in connection with Parbatta P.S. Case No. 504 of 2024, subject to the condition laid down under Section 482(2) of BNSS and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
