The petitioner seeks bail in Sessions Trial No. 80 of 2019 arising out of Chenari P.S. Case No. 154 of 2017, instituted for the offence under Section(s) 366A of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is in custody since 7.9.2018.
It is alleged in the written report that daughter of the informant aged about 16 years got disappeared from the house on 10.6.2017. On 13.6.2017 call was received on Mobile of the informant by her daughter that she was with Ajit Kumar Chamar at Delhi Haryana Border in Nagloie. He was also
Patna High Court CR. MISC. No.27592 of 2019(3) dt.13-05-2019 2/3 informed on telephone by the victim girl that she was in love with Ajit Kumar Chamar and has performed marriage with him. Thereafter, no call was received by the informant. The victim girl on recovery has given statement under Section 164 Cr. P.C. wherein she has stated that she had gone with Ajit Kumar Chamar by train to Pune. She visited different places and lived with this petitioner. She had come back to her parents house after getting herself free from the petitioner. She has alleged that she has been kidnapped by the petitioner against her wishes. In the statement recorded under Section 164 Cr. P.C. she has stated her age as 18 years. The court has also assessed her age as 18 years.
From the statement of victim girl it appears that she had visited different places with petitioner and lived with him for long time. In such circumstances, this act cannot be said to be done under coercion.
Petitioner is in custody since 7.9.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two
