The petitioner seeks anticipatory bail in a case instituted for the offences under Section 353 of the Indian Penal Code and Section 04/40 of B.M.M.C. Act.

Allegation has been made to have illegally lifted the sand and the raiding party tried to intercept, but he was able to flee from there and local people informed that petitioner alongwith his another brother used to engage in illegal business of sand. There is no criminal antecedent against the petitioner. Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioner, namely, Pawan Kumar, be released on anticipatory

Patna High Court Cr.Misc. No.37389 of 2018 (3) dt.09-07-2018 2 /2 bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Khagaria in connection with Morkahi P.S. Case No. 40 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
