2. This is the bail application of the petitioner seeking his regular bail in connection with Muffasil P.S. Case No. 100 of 2024 registered for the offence under Sections 385, 387, 504, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. According to the case of prosecution, upon investigation of Sanaha No. 674 of 2024, it was found that on 19.02.2024, a party was conducted by the accused persons in the house of one Munna Kumar and subsequently, the accused

Patna High Court CR. MISC. No.27711 of 2025(2) dt.06-05-2025 2/3 persons also fired in the air. On the basis of information given by the informant, the offence has been registered against the petitioner and other accused persons.

4. It is submitted by the learned counsel for the petitioner that petitioner is innocent and has falsely been implicated in this case. No recovery of any article has been done from the applicant. With regard to the other registered various sections of the Indian Penal Code, there is no evidence available on record on the basis of which it cannot be said that any offence as alleged can be committed by the applicant. Therefore, on these grounds, it is prayed that the petitioner may be granted benefit of bail.

5. Learned counsel for the State opposes the arguments raised by the counsel for the petitioner.

6. Considering the submissions made by the counsel for the petitioner and further considering the detention period without commenting other merits of the case, I am of the view that it is a case where the petitioner should be granted benefit of bail.

7. Accordingly, the application is allowed.

8. The petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two
