JUSTICE SANJAY PRIYA ORAL ORDER 21-12-2017 Heard learned counsel for the petitioners and the State. The petitioners apprehend arrest in Muffasil P.S. Case No. 196 of 2016 instituted for the offence under Sections-30(a), 38(i), 41(1) of Bihar Prohibition and Excise Act and Section-120(b), 34 of the Indian Penal Code. From paragraph-3 of the petition, it appears that the petitioner is involved in 4 cases of Excise Act and this shows that the petitioner is a habitual offender of being involved in Excise Cases. In such circumstances, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail stands rejected.
The petitioner is directed to surrender in the court below and seek regular bail which will be considered and disposed of on its own merit without being prejudiced by this order.
