The matter has been taken up through video conferencing.
The petitioner seeks bail in Ballia P.S. case No. 470 of 2019 registered u/s 394/411/120-B of the IPC. The informant alleged that on 20.12.2019 she had gone to Nurjamapur village for collecting money from the loanees. When the informant reached near Dandari Railway crossing, two persons came on a Pulsar motor cycle. Both the miscreants on the point of pistol snatched her bag and other articles. The criminals also fired. The informant further disclosed that criminals had come on a motor cycle bearing registration No. BR09M-7138. The informant also detailed about the description of the miscreants.
The learned counsel for the petitioner submits that petitioner is not named in the FIR. The name of the petitioner surfaced in the case in the confessional statement of the
Patna High Court CR. MISC. No.25056 of 2020(3) dt.20-10-2020 2/2 petitioner himself recorded in paragraph 12 of the case diary. Save and except confessional statement of the petitioner there is no material to show the involvement of the petitioner but from perusal of paragraph 12 of the case diary it appears that two persons, Krishna Kumar @ Kirandeo Yadav, the petitioner, and Mukesh Yadav were apprehended with arms and ammunition while they were going on a motor cycle bearing registration No. BR09M-7138. The motor cycle bearing registration No. BR09M- 7138 was used for committing crime for which Ballia P.S. case No. 470/2019 was registered. It appears that while the petitioner was fleeing away after committing robbery the police arrested the petitioner and his accomplice and recovered the arms and ammunition. The informant also disclosed that both the criminals who looted her had come on Pulsar motor cycle bearing registration No. BR09M-7138. The petitioner has got criminal antecedent also.
Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioners on bail. Accordingly, the same is rejected.
