The petitioner apprehends his arrest in connection with Kharik P.S. Case No. 132 of 2016 registered under Sections 302/120B/34 of the I.P.C. pending in the Court of A.C.J.M.-II, Naugachia, Bhagalpur.
Submission is that petitioner is innocent and has falsely been implicated in this case. There is no eye witness to the alleged occurrence. Further submission is that petitioner has no criminal antecedent.
Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner with submission that petitioner is named in the F.I.R. She committed murder of the
Patna High Court Cr.Misc. No.3018 of 2017 (7) dt.11-07-2017 2/2 brother of the informant along with other accused persons named in the F.I.R.
Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
