The matter has been taken up through video conferencing.

The petitioner seeks bail in Minapur P.S. case No. 77/2020 registered u/s 399, 402, 414 of the IPC and u/s 25(1-b) a/ 26/35 of Arms Act.

The informant got information that some criminals were preparing to commit cognizable offence and on such a raid was conducted. Five persons were found sitting but after seeing the police two persons managed to flee away. Awadhesh Rai @ Bakaria, Shatrughan Sahni and Pappu Paswan, the petitioner, were apprehended. From the possession of Awadhesh Rai @ Bakaria and Shatrughan Sahni country made pistols were recovered. From the possession of the petitioner two cartridges

No.25104 of 2020(2) dt.22-09-2020 2/2 were recovered The learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 26.02.2020. The petitioner has already remained in jail for seven months for recovery of two cartridges.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Hemant Kumar, learned Judicial Magistrate, Muzaffarpur (East) in connection with Minapur P.S. case No. 77/2020.
