JUSTICE SHIVAJI PANDEY ORAL ORDER 31-01-2018 Heard learned counsel for the petitioners and learned counsel for the State as also counsel for the Informant. In this case, the petitioners are apprehending their arrest in connection with Falka P.S. Case No. 61 of 2016 registered for offences under sections 406, 409, 420, 468, 504 and 120(B) of the Indian Penal Code.

The B.S.F.C. has filed a case against the present Informant and, in turn, the Informant has also lodged a case against the petitioners submitting that he was the Executive Assistant and releasing grain against the S.I.O. Therefore, it is the petitioners who are the main beneficiaries.

Patna High Court Cr.Misc. No.25472 of 2017 (8) dt.31-01-2018 As already the case has been lodged by the B.S.F.C. against the Informant with regard to misappropriation and fault, let the petitioners, namely, Suman Kumar Sharma @ Suman Joshi and Chandan Kumar Gupta @ Chandra Bhushan Gupta, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Katihar in connection with Falka P.S. Case No. 61 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
