The petitioner apprehends his arrest in Masaurhi P.S. case No. 314 of 2018 registered under Section 363, 366(A) of the IPC.
The father of the victim made allegation that the victim had gone to village Baliyari to look after her elder sister but when the informant went to bring back his daughter/ victim he came to know that petitioner enticed away his daughter for the purpose of marriage.
The learned counsel for the petitioner submits that victim made her statement u/s 164 of the Cr. P. C. and she denied the factum of her kidnapping. The victim is a major girl and her date of birth is 03.06.1997 (Annexure-3). Taking into consideration the facts that victim herself

No.30240 of 2019(2) dt.08-05-2019 2/2 denied the factum of her kidnapping and she disclosed that she voluntarily married with petitioner, who happens to be brotherin-law of her brother, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub divisional Judicial Magistrate, Masaurhi, Patna in connection with Masaurhi P.S. case No. 314 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
