JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-12-2019 This is an application for grant of anticipatory bail in connection with Bhojpur Ara Mahila P. S. Case No. 170 of 2018 disclosing offences under Sections 341, 323, 498A/34 of the IPC and Section 3⁄4 of Dowry Prohibition Act. Case is under Section 498A of IPC. On appearance of the opposite party no.2, the matter was referred to the Patna High Court Mediation and Reconciliation Center. The report of
Patna High Court CR. MISC. No.28914 of 2019(6) dt.19-12-2019 2/3 the mediator is available at Flag "C" that shows the dispute between the parties has been resolved through the process of mediation, in terms of settlement mutually agreed between them and both of them has decided to live together. Learned counsel for both the parties, have admitted the above position.
Having heard both sides, considering the above submissions, this application is allowed. Let the petitioner, above named, surrender before the court below by 07.01.2020 be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Bhojpur, Ara, in connection with Bhojpur, Ara Mahila, P. S. Case No. 170 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure on condition that petitioner has to abide by all the terms and conditions mentioned in the memorandum of agreement, otherwise, his bail bonds shall be cancelled.
At the same time, it is also expected that opposite party no.2 shall also abide by all the terms and conditions agreed upon them before the mediator.
Let a copy of the mediator's report along with
