Perused the order of the Central Administrative Tribunal, Patna Bench, Patna dated 19.09.2017 passed in O.A. 559 of 2017. Since show cause was issued upon the petitioner because of the judicial order passed in CWJC No.9740 of 2013 the petitioner should have filed his response to the show cause instead of rushing to the Tribunal seeking some kind of intervention and stay of the
Patna High Court CWJC No.15112 of 2017 dt.14-11-2017 proceeding.
In fact, if any indulgence was shown by the Tribunal in the said O.A., then it would have amounted to overreaching the judicial order of the Division Bench of the High Court. Writ is dismissed.
Petitioner has leeway to file his show cause and response, if he has not done so.
