The petitioner seeks bail in Naubatpur P.S. case No.505 of 2014 arising out of S. Tr. No.503 of 2018 registered under Sections 147, 148, 149, 323, 324, 307, 302, 379, 436 of the Indian Penal Code, pending in the court of A.D.J. 1st, Danapur, Patna.

The earlier bail application of the petitioner was rejected vide Annexure 1 series to the present application taking into account that the petitioner is the assailant. A report was called for from the trial court. It has been reported that all non-official witnesses have already been examined and only two official witnesses are to be examined in

Patna High Court CR. MISC. No.28707 of 2020(3) dt.10-02-2021 2/2 this case and the trial is likely to be concluded within a period of five months.

Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of six months from the date of receipt/production of a copy of this order. The District Magistrate, Patna and the Senior Superintendent of Police, Patna are also directed to ensure that the remaining two official witnesses are examined on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period.

Let this order be communicated to the District Magistrate, Patna and the Senior Superintendent of Police, Patna.
