2. The petitioner apprehends his arrest in connection with Bheja P.S. Case No. 78 of 2023 registered under Sections 341, 354, 323, 448 and 307/34 of the Indian Penal Code.
3. As per prosecution case, this petitioner is alleged to have assaulted on the head of informant's sister by means of spade due to which she sustained injury.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that due to previous enmity between the parties, a simple scuffle took place. The injury allegedly caused by the petitioner is simple in nature. It is submitted that both the parties have compromised the
Patna High Court CR. MISC. No.31618 of 2024(3) dt.19-06-2024 2/2 present case, as contained in Annexure-P/2 to the bail petition. Petitioner has got clean antecedent.
5. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Jhanjharpur, Madhubani in connection with Bheja P.S. Case No. 78 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
