This is an application for grant of anticipatory bail in connection with Digha P.S. Case No. 221 of 2017 registered for the offences punishable under Sections 420, 467, 468, 379, 471 and 120(B)/34 of the Indian Penal Code, Section 4, 40 and 49 of the Bihar Minor Mineral Concession Rule, 1972 and Rule 3 of Bihar Mineral Prevention of Illegal Mining, Transportation and Storage Rule, 2003.
The allegation is regarding the accused persons, named in the FIR, having stored huge quantity of various types of sands and stones in their premise and upon being apprehended by the Police no proper document could be produced.

No.59240 of 2017 (3) dt.10-01-2018 2/2 The learned counsel for the petitioner submits that as far as the petitioner is concerned, he is not named in the FIR and his name has subsequently transpired in the present case on the allegation that Hywa was being used in illegal manner. It is submitted that the petitioner has a clean antecedent. Considering the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrte, Patna in connection with Digha P.S. Case No. 221 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
