Petitioner is accused in connection with Kishanganj Mahila P.S. Case No. 20 of 2016 registered under Sections 376, 504, 506/34 of the I.P.C. and section 4 of the POCSO Act. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in this case. Further submission of learned counsel for the petitioner is that in the instant case, F.I.R. is lodged after lapse of three months. It is also submitted that petitioner has no criminal antecedent and is in custody since 06.02.2019.
