The petitioner is in custody since 17.08.2021 in connection with Special Excise Case No. 5094 of 2020 arising out of Sigori P.S. Case No.144 of 2020 registered for offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
There is recovery of 80 litres of country made liquor from the bank of Punpun river.
Considering the fact that the petitioner has seven antecedents - 6 cases under the Bihar Prohibition and Excise (Amendment) Act and one under the Indian Penal Code and he
Patna High Court CR. MISC. No.30290 of 2022(2) dt.20-08-2022 2/2 is in custody since 17.08.2021, he shall be released on bail after framing of charge or on completion of one and half year in custody whichever is later, on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Danapur, District Patna in connection with Special Excise Case No.5094 of 2020 arising out of Sigori P.S. Case No.144 of 2020. The petitioner will visit Sigori Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
