JUSTICE SANJAY PRIYA ORAL ORDER 01-08-2018 This case has come up under the heading 'To Be Mentioned' at the instance of the Petitioner. Learned counsel for the petitioner has submitted that in the bail petition he has mentioned Complaint Case No. 2981 of 2017 but in the data base of the computer inadvertently it has been mentioned as P.S. Case No. 2981 Year 2017 including Complaint Case, due to which, in the order dated 4.7.2018 at the top of the cause title, "Arising Out of PS Case No.-2981 Year 2017 ThanaPatna Complaint Case, Distt. Patna" is appearing. Similarly, counsel for the petitioner seeks modification in condition (i) of the aforesaid order to the extent that bailors should be local having

Patna High Court Cr.Misc. No.39063 of 2018 (3) dt.01-08-2018 2/2 sufficient immovable property within the jurisdiction of Patna District.

It appears from the order No. 2 dated 4.7.2018 passed by this Court that in second and last paragraph of the order, Complaint Case No. 2981 of 2017 is clearly mentioned. Therefore, there is no need to make any correction in the top of cause title of the aforesaid order as well as in data base of computer. So far modification of condition (i) of the order No. 2 dated 4.7.2018 is concerned, let condition (i) of the order dated 4.7.2018 be modified to the extent as mentioned below: "(1) bailors should be local having sufficient immovable property within the jurisdiction of Patna District".

Two weeks' further time from the date of receipt of this order is granted to the petitioner to surrender before the court below.

Let this order be communicated to the Additional Chief Judicial Magistrate-Patna, in connection with Complaint Case No. 2981 of 2017.
