The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that illicit liquor has been recovered from the house of the petitioner. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, his payer for anticipatory bail is rejected in connection with Siwan Town (Sarai) P.S. Case No. 737 of 2018 pending before the court of the learned 2nd Additional Sessions

Patna High Court CR. MISC. No.28727 of 2019(4) dt.21-08-2019 2/2 Judge-cum-Special Judge, Excise, Siwan.

Accordingly, the application is dismissed.

However, petitioner is directed to surrender before the learned court below and if he does so and makes prayer for bail, the learned court below shall consider the bail petition of the petitioner on the same day.
