2. The petitioner seeks bail in a case registered for the offence punishable under Sections 364A of the Indian Penal Code and later on, Sections 341, 323, 379, 120B and 34 of the Indian Penal Code were added.

3. As per prosecution case, informant alleged that on 26.11.2021 at about 7 PM, he received a telephonic information that his father has been kidnapped and the kidnappers are asking for ransom of Rs. 2,00,000/-.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated in this case due to village politics. Name of petitioner transpired in this case on the basis

Patna High Court CR. MISC. No.27786 of 2025(2) dt.04-07-2025 2/2 of confessional statement of co-accused Sanjeev Kumar, who has already been granted bail by a Co-ordinate Bench of this Hon'ble Court vide order dated 16.03.2023 passed in Cr. Misc. No. 35230 of 2022. It is further submitted that similarly situated co-accused person, namely Prashant Kumar, has already been granted anticipatory bail by a Co-ordinate Bench of this Hon'ble Court vide order dated 04.07.2023 passed in Cr. Misc. No. 21661 of 2023. Charge-sheet has already been submitted and petitioner has been remanded in this case since 28.10.2024.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstances of the case, nature of accusation, claim based on parity and period of custody, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Kanti P.S.
