Pursuant to the last order dated 05.05.2023 by an earlier bench of this Court, a counter affidavit on behalf of the respondent no. 2 has been filed in which in paragraph-7 and 8 it has been incorporated as follows:- "7. That the Senior Treasury Officer, Vikash Bhawan vide his letter no. 235 dated 17.05.2023 has informed that a team was constituted headed by one Sri Ghanshyam Kumar, Assistant Treasury Officer, Secretariat Treasury, Vikas Bhawan vide his letter No. 223 dated

Patna High Court CWJC No.17801 of 2014(17) dt.18-05-2023 2/3 09.05.2023 to visit petitioner's house as per the directions of the Hon'ble High Court.

8. That the team visited the residential house of the petitioner located in Arwal district as per the address mentioned on the P.P.Os, to get identification of the petitioner. But the petitioner was not available at his residential house and so the team was unable to meet the petitioner. The petitioner however was contact on mobile No. 7979703305 which was made available by the advocate of the petitioner. The petitioner Sri Krishna Prasad Verma sent an application on 09.05.2023 over whatsapp informing that at present he is abroad in Germany and will be staying in Germany till 29th June, 2023. He further added that as soon as he is back to India he shall contact the Senior Treasury Officer, Vikas Bhawan to further initiate the process of his pension. The Senior Treasury officer, Vikas Bhawan has made. available the application dated 09.05.2023 sent by the petitioner Krishna Prasad Verma along with letter No. 231 dated 11.05.2023 issued from the Office of Senior Treasury Officer, Secretariat Treasury, Vikas Bhawan."

Learned counsel for the petitioner accepts that the petitioner is presently in Germany and will be returning on 29.06.2023. He further submits that the petitioner has undertaken to inform the concerned officer regarding his
