====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 04-05-2026 Heard Mr.Aditya Kumar, learned counsel for the petitioners and Mr.Syed Mojibur Rahman, learned Additional Public Prosecutor for the State.

2. The petitioners seek bail, who are in custody since 03.02.2026 in connection with Nayagaon P.S. Case No. 61 of 2015, F.I.R. dated 30.10.2015 registered for the offence punishable under Sections 147, 149, 341, 447, 323, 307, 354, 504 & 506 of IPC.

3. The petitioners have clean antecedent. Earlier the petitioners have been granted bail but their bail bond were cancelled on 08.06.2022 but the petitioners did not comply the order of this Court, then again the bail bond of the petitioners

Patna High Court CR. MISC. No.29698 of 2026(2) dt.04-05-2026 2/3 were cancelled on 21.09.2024 but the petitioners have been granted bail by this Court vide order dated 24.03.2025 and 08.04.2025 with condition to appear physically till disposal of the case but the petitioners did not comply the order of this Court and their bail bond were cancelled on 31.07.2025. Learned counsel for the petitioners further submit that the petitioners came to know about the aforesaid then they have surrendered on 03.02.2026.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioners.

Considering the aforesaid fact and petitioners have clean antecedent, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand)each with two sureties of the like amount each to the satisfaction of learned Dist. & Addl. Sessions Judge VII, Begusarai in connection with Nayagaon P.S. Case No. 61 of 2015, with the following conditions:- (I) Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on theri absence on two consecutive dates without sufficient reason, their bail bond shall be cancelled by the Court below.

Patna High Court CR. MISC. No.29698 of 2026(2) dt.04-05-2026 3/3 (II) If the petitioners tamper with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.

(III) And, further condition that the court below shall verify the criminal antecedent of the petitioners and in case at any stage, it is found that the petitioners have concealed their criminal antecedents, the court below shall take step for cancellation of bail bond of the petitioners. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
